Allahabad High Court stays order suspending licence of Sanjay Gandhi Hospital in Amethi | Lucknow News

The Allahabad High Court on Wednesday stayed the order suspending the licence of Sanjay Gandhi Memorial Hospital in Amethi’s Munshiganj area over a case of medical negligence.

A Bench comprising Justice Vivek Chaudhary and Justice Manish Kumar stayed the Amethi Chief Medical Officer’s September 17 order while hearing a petition filed by hospital administration.

The licence of Sanjay Gandhi Hospital – run by a Trust led by former Congress president Sonia Gandhi — was suspended on September 17 and the facility was sealed after a woman who was admitted there for a minor operation died in a Lucknow hospital on September 14. The woman’s husband, who got an FIR registered against the Sanjay Gandhi Hospital, alleged that she died due to an overdose of anaesthesia.

“The (High) court has stayed the order suspending the registration of the hospital. The court has given the ground that negligence can happen at hospitals, but there is a greater public good in the hospital functioning than it being shut down. The court said that only because there is an allegation of negligence against the hospital, it is not reason enough to shut down the hospital as that would result in more people suffering,” Senior Advocate Jaideep Narain Mathur, who appeared on behalf of the hospital, told The Indian Express after the High Court’s order.

Mathur said that he argued that CMO passed the order even though he lacked the jurisdiction.

Government Counsel Rahul Shukla said that the High Court has granted time to the state to file a counter affidavit in the case.
